Introduction

Welcome to Mwarandus Lab. By accessing our website, booking a consultation, or purchasing any product or service, you agree to be bound by these Terms of Service. Please read them carefully before proceeding.

These Terms apply to all visitors, clients, and customers of Mwarandus Lab, whether accessing our services online or in person.

Mwarandus Lab is a sole proprietorship registered in Kenya and operating from Nairobi. We provide hardware engineering, software development, IoT solutions, electronics repair, custom prototypes, technical consulting, and related services to clients locally and internationally.

Scope of Services

3.1 Local Services (Kenya)

We provide the following services to clients based in Kenya:

  • In-person and remote consultations
  • Custom hardware engineering and prototyping
  • Software development (web, mobile, desktop, IoT)
  • Electronics repair and maintenance
  • Technical documentation and proposals
  • Maintenance contracts (terms agreed per client engagement)

3.2 International Services

For clients outside Kenya, we currently offer:

  • Online consultations (Zoom, Google Meet, Phone, WhatsApp)
  • Software development and delivery
  • Digital product purchases and downloads

International payments are accepted in USD. The applicable payment method will be communicated at the time of engagement.

Bookings & Consultations

4.1 Booking Confirmation

All bookings are confirmed upon receipt of payment (where applicable) or upon written confirmation from Mwarandus Lab.

4.2 Rescheduling

Rescheduling is permitted up to 12 hours before the scheduled session. Contact us at [email protected] or call +254 748 613 509. Requests made less than 12 hours before the session will not be accommodated and a new booking fee will apply.

4.3 Cancellations & Refunds

  • All bookings are non-refundable once confirmed.
  • If a session is not rescheduled before the 12-hour deadline, the booking fee is forfeited and a new booking must be made.
  • Urgent consultations (KES 500) are non-refundable under all circumstances.

4.4 Consultation Disclaimer

All consultation services are provided in good faith based on information available at the time. Mwarandus Lab does not guarantee specific outcomes or the success of any project or business decision based on advice given. The client assumes full responsibility for all decisions made. Liability shall be strictly limited to the fees paid for that specific session.

Products — Store

5.1 Software Projects

Upon successful payment, a secure time-limited download link is sent to the buyer's registered email address. Software products are sold under a Single-Use / Standard Licence:

  • The buyer may use the code on one (1) project or domain.
  • The buyer may not resell, redistribute, or share the source code with third parties.
  • Ownership of the underlying codebase remains with Mwarandus Lab; the buyer is granted a licence to use it as described.

5.2 Refund Policy — Software Products

A refund may be requested within 5 days of purchase if the delivered software does not meet its stated deliverables:

  • The buyer must raise the issue via email within 5 days.
  • An online meeting will be arranged to verify the reported issue.
  • If the issue is confirmed and cannot be resolved, a refund will be processed.
  • Refunds will not be issued for change of mind, incompatibility with the buyer's own systems, or if the buyer has modified the source code.

5.3 Document Products

Documents, proposals, and academic project files are delivered by secure download link immediately after payment. A refund may be requested within 2 days if the document does not meet its stated deliverables, following the same review process as software products.

5.4 Hardware / Refurbished Components

  • All hardware is sold as second-hand / pre-owned unless explicitly stated otherwise.
  • Buyers are strongly encouraged to contact support via WhatsApp (+254 748 613 509) or email before powering on any component for the first time.
  • Warranty is void if the component is powered on without prior support contact and damage occurs as a result.
  • Mwarandus Lab shall not be liable for any indirect, incidental, or consequential damages including equipment damage, data loss, or loss of profits arising from use of hardware products.
  • Liability, if any, shall be strictly limited to the amount paid for the product.

Custom Project Engagements

6.1 Custom Software Development

The client shall own the full codebase upon final delivery and full payment. Mwarandus Lab retains the right to reuse general components and techniques in future projects, provided that such reuse does not replicate the client's specific product or implementation in a way that competes with or adversely affects the client's business interests.

6.2 Custom Hardware & Prototypes

The client shall own all deliverables including design files, schematics, PCB layouts, and associated documentation upon final delivery and full payment. Mwarandus Lab retains no rights to reproduce or commercialise the client's specific hardware design.

6.3 Maintenance Contracts

Maintenance contracts are available and negotiated individually. Specific terms, duration, and pricing will be set out in a separate written agreement.

Payments

7.1 Payment Methods

We accept M-Pesa for local transactions and USD payments for international clients. The applicable payment method will be communicated at the point of purchase or booking.

7.2 Payment Authorisation

By completing a payment via M-Pesa, the customer confirms that they are the authorised owner of the phone number used and approve the transaction. Mwarandus Lab is not responsible for transactions completed by third parties who have access to the customer's mobile device or M-Pesa PIN.

7.3 Service Delivery

Once a service has been delivered or a product successfully accessed or downloaded, the transaction shall be considered fulfilled and non-reversible, except where a valid refund claim is raised within the applicable refund window.

7.4 Payment Disputes

Any payment dispute must be reported directly to Mwarandus Lab within 24 hours of the transaction before escalating to M-Pesa or any mobile network operator. Disputes raised without prior notification may not be eligible for resolution.

Intellectual Property

All content on the Mwarandus Lab website — including text, graphics, logos, and code — is the intellectual property of Mwarandus Lab unless otherwise stated. You may not reproduce, distribute, or use any content without prior written permission.

Products and deliverables are subject to the specific ownership terms outlined in Sections 5 and 6.

Age Requirement

By using our services or purchasing our products, you confirm that you are at least 18 years of age. If you are under 18, you may only access our services under the supervision of a parent or legal guardian who accepts these Terms on your behalf.

Privacy & Data

We collect and process personal data only as necessary to provide our services and process payments. We do not share customer data with third parties beyond what is required to process payment transactions.

We use Cloudflare analytics cookies on our website. All other data practices are governed by our Privacy Policy.

Customer data is retained for reference purposes, including dispute resolution. You may request deletion of your data at any time by contacting [email protected].

Limitation of Liability

To the maximum extent permitted by applicable Kenyan law, Mwarandus Lab shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or products, including but not limited to loss of data, loss of profits, or business interruption.

In all cases, our total liability to any client shall not exceed the total amount paid by that client for the specific service or product giving rise to the claim.

Dispute Resolution

We encourage all clients to contact us directly to resolve any dispute informally in the first instance. Most issues can be resolved quickly through direct communication at [email protected].

Any dispute that cannot be resolved informally shall be referred to and finally resolved by arbitration under the rules of the Nairobi Centre for International Arbitration (NCIA). The seat of arbitration shall be Nairobi, Kenya. These Terms shall be governed by and construed in accordance with the laws of Kenya.

Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
